Accident case

On 19-06-2016 in haryana my friend was driving his car in his side (left side of the road). And was in an ideal speed but a bike came from the other side and the bike was uncontrolled so that bike crashed into the car and one of the two boys on the bike was dead at the spot and the other one who was riding the bike was injured badly. But the car was in its side and the wheels of one side of the car was also down from the road. So it was Clear that there was no fault of the car driver.. But police filed the case against him under section337,279 and section 104(A). And one more thing that the IO also said that there was no fault of the car driver at the scene of crime. What should he do now. Should he asked for a re investigation by the police or can he prove it in the honorable court?
