Pre requisites for absorbtion of temporarily engaged labours

IN A PUBLIC SECTOR ORGANISATION, SO MANY PEOPLE WERE WORKING FOR MORE THAN 7 YEARS AS TEMPORARY SWEEPERS.  THEY HAVE BEEN TOILING FOR MEAGRE SALARY WITH THE HOPE THE UNIONS WILL GET THEM PERMANENT EMPLOYMENT.  BUT MANAGEMENTS REFUSED TO ABSORB.  WHAT IS THE LEGAL RECOURSE AVAILABLE TO THEM?  WHAT IS THE IMPORTANT DOCUMENT TO BE PRODUCED IN A COURT OF LAW, ABOUT THERE TEMP EMPLOYEMNT WITH PSO.: 01. CERTIFICATE FROM THE MANAGER,  OR 2. RECEIPT SIGNED BY THE LABOURER (NAME OF THE RECEIPIENT IS DIFFERENT BUT THE SIGN IS SAME) OR 3. ANY OTHER WITNESSES BY THE STAFF/CUSTOMERS/OFFICERS WILL HOLD GOOD TO TESTIFY THEIR TEMPORARY WORKING....,  PL ADVISE.

Now Courts can not interfere in directing those authorities, as Apex Court has ruled that recruitment shouldl only be done through laid down selection procedure only.

1) Agreed with the above expert opinion.

 

2) Candidates engaged on Temporary or Outsourcing basis are entering through the back door depriviing all the otherwise eligible candidates in a regular recruitment process as observed by the apex court.

 

3) Instead of waiting when such candidates will be absorbed permanently, before getting age barred, without wasting time and money through courts, not relying on political promises, better prepare well for the competitive examinations and secure a job.

 

4) If in due course by chance get the permanent absorption, then it is all the good.
