Kamlesh Kumar (Government Official)     30 December 2010

Joining another central govt job.

Respected sirs,

A government employee with department of posts since last 4 years.  3 years ago he was entangled in a fraud/loss case. A disciplinary proceeding u/r 16 of CCS (CCA) Rules, 1965 was initiated against him. On completion of the disciplinary proceedings he was awarded punishment of recovery of Rs 11,650/- from his pay & withholding of next one increment for 6 months. Now both the punishment is over & his appeal against these punishments is pending with higher authority.

Now he has been selected for another central government job & willing to join that, his present employer is also ready to relieve him.

He would like to know whether these punishments will have any effect on my new assignment/career.

Get relieved from the present employer and join in the new post..This will in no way affect your future assignment  if you have proper relif.

When duration of penalty is already over, it will not cast any effect in your future career in any other department or post ouside the cadre. The effect of punishment remains till its duration. However, if you remain in the same cadre with the same department, your futher promotion can have some effect, if due within the next five years after the award of penalty, as annual confidential records are seen for the last five years at the time of consideration for promotion for the purpose of asessment of eliibility for promotion to next post.
