workmen compensation

(Querist) 11 January 2010 This query is : Resolved 
one of our contract driver died due to asphyxia while he was on duty. Can he be entitled to get Workmen Compensation.

There should be a direct connection of death and the duty. If any employee died in the course of his employment and due to reasons connected with his duties only then he is entitled to claim under WC Act.

'dependants' can file claim if the death is during the course and out of employment
