Querist : Anonymous (Querist) 11 October 2010 This query is : Resolved
Sir,
I am a retired govt.servent. due to my family circumstances i barrowed some loan from my friend 15 years ago.For that amount he urged me a collasteral security.I am from a poor dalit family.I got nothing to give him as cooasteral security.
While I am in service I purchased a house from TNHB by availing Govt.Loan.For that Loan amount I pledged the house to the Govt.He urged me a sale agreement on that hose with possesion rights and loan amount
shown as advance amount for the house.
At that time the owner ship title is not in my name becaus i pledged the house to govt.house loan.
He is a millioner.He muscular,men,money
and politicl supports.I cant do anything
against him.I made an agreement with my own
handwriting in Rs.10/stamp paper. It was not regestered. After that i repay the amount and asked to return back the agreement. He has not given receipt for that amount and that has adjusted towards intrest.
He simply told that i was sold the house
to him.I was shocked and file a suit against him. After receiving court notice
by forcfully vaccated me from my house and dumped rowdies and gundas in my house.
I send complaints to the police. But no action is taken against him.
I request the learned councils please do
help me to give technical advises, relevent Laws and Higher courts Judgements supporting my suit.
sincerely,

you should give a written complaint against the person and his accomplices to police. If the police fails to take action u could move to court

If any suit is pending then mention the development about your forceful eviction and call for intervention of the court.
Against the use of force file complaint at the nearest Magistrate u/s 156(3) crpc bringing the necessary charges.
