My sister field sec 125 but she got judgement from the court . Court order to her husband to give maintanence to her son not my sister . But my sister was appeal for maintanence to herself & her son.
My question is now what we do ?
The execution date was 20 th December . Our advocate told us he done that on 20 th December . But we have little doubt on our advocate . Now tell me in case if our Advocate didn't appeal for execution on 20 th December can we appeal to the court for execution at now ?

If her husband don't give maintanence which is the best procedure . Can we appeal to the court for arrest warrent or we appeal to the court to attach his property . Please suggest which is the best . Because if he arrest he get bell from court easily .

Our advocate suggesting us to further appeal to the court for maintanence of my sister . So he not showing interest to execution of the judgement also showing less interest to appeal to the court for arrest warrent . Our advocate giving interest his own business . So please suggest what we do ? How we appeal to the court for arrest warrent or property attachment of sister Husband . Kindly suggest me .

Politely in a very friendly way collect the Change of Vakhalat from him.It could be requested thro Registered Post with ack due also.If No reply from him for 15 daus from him you could change your advocate with the proof of serving the Request for Change of Vahkalat.There are Free Legal Aid Forums for Women in all the Courts approach them and Seek their Guidance and Assistance and It will be Done

OK. But if I ask him to change of vakhakatnama directly not through post &if he denied then what we do ?

Most of Indian courts are online, can check the status of your case / appeal / execution if filed.

Can file the execution if maintenance not received from husband.

Execution may not be filed through same lawyer, you can proceed through another lawyer.
