(Querist) 29 March 2024 This query is : Resolved
Respected sir query regarding standing order of trade union labour of daily wages workers
It has been said in law that standing order cannot be modified upto 6 months on the date it has been come into force and.of there is any agreement between the employer or the trade union than that agreement is accepted
Respected sir this agreement is done by individual workman or the trade union can do the agreement on behalf of all the work men
Can this agreement can be challenged in the law as if we all know sir labour workers are unaware of there rights and results to exploitation of agreement is done which is not favourable to the worker itself can it be ask for change or any modifications
Kindly guide

It depends on the terms of agreement.Consult Inspector of Labour of the area.

The standing order made by the employer against the employees only and not against the trade union.
The trade union can fight against the employer if it is causing any harm to the labors, but it is not known what is the subject of the standing order.
What is the context of the standing order which has aggrieved your labors.
Instead of discussing your problems you have written on a plain language all about the other issues except the main issue or the problems you face due to this standing order

Under Industrial Employment(Standing Orders) Central Rules, 1946 I think there is no such rule to modify the standing orders. Usually, If the Government thinks that it is necessary to add or delete any standing order or rule, will issue orders.
