Depends on the company policy, leave rules.

My not necessarily depend entirely upon Company or company's internal/private policy.

First of all determine the establishment/your office-division etc in private sector is registered as: Commercial or Industrial?

Then look into the corresponding enactment that shall govern the leave rules e.g. ( name of the state) Shops & Estab Rules........

You may also determine if you are covered by ESIC and look into instances when salary shall be paid by employer or ESIC.

In certain cases in case Group Insurance Policy is existing say from LIC;;;;; the salary/part salary may be paid by insurer.

The company can frame its private policy after negotiations with employees/employee's representatives-union-trade unions, vide standing orders................that provides for superior benefits but can not offer inferior benefits.

Your employee's/trade union leaders, able labor law consultant can guide you further.
