(Querist) 09 August 2011 This query is : Resolved
Hi,
I am working in Pvt. ltd company. On 1Aug 2011, I have resigned my job with 30n days notice period as per company rule mentioned in appoint letter. But one of the senior person with relieving authority told me that I can not accept your resignation, hence you will not be relieved or you will not get the relieve letter. I have joined before 2 & half months before. Now I am on probation period for six months. Pls. suggest me what to do as early as possible.
Thank you all.

1)what were the terms and conditions mentioned in your appointment letter .

2)was there any clause that you cannot during the period of probation resign?
Saket Agarwal (Expert) 09 August 2011
It all depends on the conditions as stated in the appointment letter. If there is no clause as to the probation, i feel the employer might be harassing you.

Yes, its depends upon the terms and conditions in your appointment order.

Dear all, there was not any condition in appointment letter stating that you are not suppose to resign within probation period.
I am totally independent to resign. But problem is that, my new employer is insisting relieving letter from my current employer. So, is there any way to come out of this problem? I want to join my new employer any how. Pls. Guide !!!

As you are in the prescribed period of probation, is there any condition that one/two/three months notice is required to be given or in lieu of notice period any amount to be paid.

However, put up a request to the authorities explaining the reasons for your resignation and request them to consider your request sympathetically.

Already replied against your similar question elsewhere. However, the reply is repeated here also, as follows:

If you don't have any proof of submission of your resignation notice, you need to take proper caution not to get yourself treated as absent without permission on leaving your job. In that case, you may better submit your reminder notice by Registered Post Acknowledgment Due, in addition to sending an email reminder, making a clear mention that the resignation may be deemed to have been effective with effect from ......... (mention date) if no response is received from the management. Also refer the original notice and attach a copy of the original notice with the reminder notice.
