Pagdi tenant in mumbai

My 30 years old tenant having a shop in mumbai suburb has suddenly given his shop to third party and vanished .In this case what step i should take as a landlord.

Collect evidence that third party is in occupation and start eviction suit under Maharashtra Rent Control Act , you will get your shop back permanently .

Issue a legal notice to the tenant as well as occupant for handing over vacant possession of demised property.
It would be advisable to consult a local prudent lawyer for better appreciation of facts and documents, guidance and proceeding.

1. You can file a Police FIR, requesting investigation and charge-sheet, for offences like cheating, intimidation, trespassing, breach of trust etc.... against the old tenant and this new person, supported with all relevant supporting documents.

2. IF the Police does not take action, THEN you can file private criminal case u/s 156(3) Cr.P.C., in the local Magistrates court, seeking directions to the Police to investigate and file charge sheet. The said Person may come down for settlement.
