Information to be submitted for rti act

(Querist) 02 March 2012 This query is : Resolved
Sir,
I am working in PSU. For many RTI cases we are supplying information. In many cases the information which we are not suppose to maintain is also asked. For example the information about contact workers EPF, wage register etc. The works are carried out through contractors.
1. Is it binding on PSU to collect the information from contractors and supply for RTI case?
2. Whether is it binding on PSU to supply information which is maintained by contracters and available with PSU?
3. Whether individual EPF and wage details comes under personnel information?
Raj Kumar Makkad (Expert) 02 March 2012
1. This is your duty to do so.

2. You may simply intimate that the whole work is done by contractors as such no such record is maintained.

3. Yes, such information is personal.

Agreed with Makkad Sa'ab.

However in certain cases, it is held by CIC that EPF information can be supplied under RTI.

Regards,

Even if the work is done through contractor you (.SU) continues to be principal employer and continues to be responsible for enforcement of labour laws. It is the duty of principal employer to see that contractor maintains all records and also has right to inspection of and securing such records. therefore Principal employer is duty bound to procure such information and provide. EPF information is personal unless related to public interest.
