(Querist) 21 January 2018 This query is : Resolved
Sirs, I am defendant in specific performance 1963 act filed by a firm my queries are
1). If the firm was unregistered as on date of filing suit can I seek dismissal on this ground
2). I breached status quo injunction as I was not informed of stay by my lawyers.
In 2009, Where as contempt application filed in 2015.
Suit is regarding plot title. But plot was sold before c/s came on board 8 years back.
Query simplified to elicit reply. Regards

Whatsoever be your excuse, no respite. Registered or unregistered, a firm is a firm established to do business and earn profit.

Information to your authorised attorney is information to you So, no escape with respect to your question #1 & #2.

However, instead of depending upon casual nature of advice on your casual type of query may harm your interest more rather than being of any benefit. So, better consult some expert by getting your documents examined in detail.

Suit is filed by a fictitious / on paper unregistered firm to honor the transfer agreement of plot after 17 years, time was not specified in agreement executed by my late poa. Possession as mentioned by petitioners in suit is with them. Actually they sold off the plot to third party with possession but without title. Plot title transferred by me unaware of injuction, before case came on board, petitioners may be came to know very late and filed contempt application after, 6 years. Please
advise the course of defense. Lawyer hired by me not cooperating at crucial stage. I am outsider to court place.

Better change the lawyer, if not satisfied with the service of your previous lawyer. Any casual help on hit & trial basis may prove to be more costly to you.

Dhingara sir
What about time limitation. Breach conducted in 2009, contempt application filed in the same suit in 2015.
P. Venu (Expert) 22 January 2018
The contempt application ought to have been filed within a period of one year.
