Part time doctors/honorary doctors treated as employee (esic

Under Esic Act 1948, part time doctors to be treated as 'employee' or not for the purpose of calculating limit of 10 person or more to apply ESIC act on Hospital runned by charitable & religious trust. Please revert with relevant case laws apply on this situation also.
