PROCEDURE FOR DELETION OF NAME AS A HOLDER

What is the proedure for deletion of Name as a First Holder(on death) in the Flat in Cooperative Society, Mumbai,while second Holder (his wife) is alive & want to remain as a single holder of the property ?

Which are the documents need to be submitted to Society ?

Dear Priyanka,
Simply give the application with the death certificate of the spouse.
The documents - Registered Sale Deed & Death Certificate of Husband; Supporting with the application.

There is no provision to delete the name of deceased person from lease deed. However the LR's shall inherit the property of deceased person, amounts to transmission.

In case of joint holder of a immovable property, the name of the deceased person
may be deleted by way of mutation in Mun.Corp.; I suggested for the same.

You can execute a RELEASE DEED in favour of other party to alinenate your share in the said prperty in favour of other party.

This release deed would amount to conveyance deed and stamp duty shall be levied at the prescribed rate, since it's the self earned property.

Mutatation is possible, but it is a way to incorporate the names of LR's of deceased
