Termination without assigning reason

(Querist) 13 June 2017 This query is : Resolved
My appointment letter as prof in a deemed university (private) had clause about termination without giving reason by employer with 3 months notice or salary. After 3 years of service they have terminated me with immediate effect without giving reasons and three months salary. My performance, confidential reports are outstanding. I even have appreciation letters. Can I take any legal recourse against this action. Can the university add such a clauses in appointment of academic professionals ?

Ms. Sunita,

Termination orders do not contain any reason for doing so. Nothing is wrong in the clause of termination. Of course, you can take legal recourse. But still your services cannot be imposed by any court, if they justify that there was no further need of your services.

But question arises, why do you want to stick with the employer, who terminated you and even if reinstated on service by any reason, they would certainly try some formula to ruin your career rather than termination.

Better try for job somewhere else.

Dear LCI Author @ Ms. Sunita,

The jobs that too at senior positions are not so easily available.

Isn't it!

So your concern is genuine.

"After 3 years of service they have terminated me with immediate effect without giving reasons and three months salary."

What exactly do you mean from it.

The notice pay of 3 months has not been supplied to you?

Has the service certificate, relieving letter, FnF statement, acknowledgment of Handover of assets, NOC/NDC etc etc as required/applicable/per precedence-practice been supplied to you.

Do you see any adverse comments in such docs!
