Release deed

my grandfather left a property without making any will and died in 1983.My father and uncle and aunty endorsed their names after completing the formalities.my father and uncles and aunt died recently in last 4 years. myself and brothers have already given application to endorse our names in place of my fathers share but evenafter a year or so the pune cantonment has not changed the names.Now i want to buy this property by paying the shares of my uncle and aunt to their sucessor (sons/daughters/grandson etc)through a registered release deed. Is it possible to get this release deed registered though our names are not there on the property card.There is no dispute about the share and all sucessors are ready to come and sign in front of the registrar.Also clarify the validity of this release deed.

It can be done. And such release deed is valid. And while applying for the name of the successor the said release deeds need to be filed with the revenue department. If you need further help, you can contact me.

Necessary details of inheritance shall be mentioned in the release deed. so contact a senior lawyer or at least document writer to scribe the document. if it is registered it is valid under law.

First ---- Lands in Cantonment area specially Pune Cantonment Board their they called land records GLR (General Land Register)

Second -- GLR extract in Pune Cantonment you get in Engineering Dept (At least 2 years ago , details I got there on first floor)

Third -- Vast track of Land under Pune Cantonment board is Lease land given under Govt Grant Act , This act is central act

Fourth --- Terms and condition attached to this land is required to be checked and studied and if required land is first required to be transferred to transferable land

Fifth -- Once this land becomes transferable then only you can do such transaction safely.


Please note don't go for short cut , go for proper procedure , Land and property person keeps for decades and generation and if steps are not taken at first stage it creates problem in future a lot beyond anyone imagination.

Additionally this rules are also changing , means I may be in mindset of 2 year ago rule and if last 4 months ago some rule have changed then I may be wrong. So it is required to go and check latest rules regulation from them or get proper copy and then take steps.

Release deed can be done but once Title is required to be checked by professional about my slight doubt on Pune Cantonment board land.

Generally such lease fee are nominal due to devaluation and people presume they are only owner and title may be /may not be different.

Since some land lease fee is so nominal they forget to pay for decades and even authorities forget to demand unless until it is high arrears

I agree with Mr. Madhu, he has given detailed explanation to be in precautions mode, So just follow as Mr. Madhu suggested.

When anyone wants acquire any property its title and possession is most important, So documentation should be in line with perfection.

As far as Release deed is concerned it can be executed by the successors of the deceased owner if he does not have any legal impediments.
