Sir,

Can the employees working in a company located in SEZ (Gujarat) start trade union, and trade union are allowed enter in the SEZs establishments

Right to form an association is enshrined in the Constitution. Thus trade union activities in SEZ is not illegal.

Mr. Akhilesh you are senior manager HR ,means you are experienced in HR matters. What gives an impression that a trade union may not be formed in SEZ ? please share your information and we would like to discuss that.

We have received notice from one Trade Union for formed trade union in your company.

our plant located in SEZ-1 Dahej (Gujarat) area.

please let me know trade union (Authorised to ) formed in SEZ Dahej area or not. any notification for the same.

FORMATION OF TRADE UNION IS FUNDAMENTAL RIGHT OF WORKMEN IRRESPECTIVE OF PLACE OF LOCATION OF INDUSTRIAL UNIT. All that is required is that 7 person who are members of trade union must subscribe to its formation and make an application to Registrar. If registrar is satisfied that application is complete in all respect it will grant registration. So workmen in your factory have a legal right to form a trade union.

Thanks for prompt response.

Formation of trade union is fundamental right of workmen it is ok.

But our plant location at "Special Economic Zone SEZ-Dahej Gujarat" they are legaly rights to formed a trade Union.
