Hello Experts,
I have a query regarding marital dispute, as one of my client got married 9 years back and has a 6 year old girl child (baby was conceived immediately within 1 year of marriage)and after the baby was born my client's husband deserted her and his where abouts are unknown almost since 8 years, as my client says that he got married to some other lady and have kids with her also, whereas he has deserted her also. So now my question is under what ground she can file a divorce and what will be the duration for granting of divorce.

She could file a divorce on the grounds of her husband.'s Adultery with all the Evidences mentioned to you by her.if she is in hurry for Divorce and if Husband Could be contactsd they could Go for Mutual consent divorce and it could be completed in 6 month time.If husband can not be contacted she could still file divorce petition basing on old address where they lived together and if summons get returned Court would advise for News Paper publishing and then Court would decide Ex Parte which would take Minimum One Year.Some times court may Insist on missing complaint with Police all at the Discretion of Honorable Court

For that A Missing Complaint Should have Been Filed and Registered With concerned Police Before 7 Years with News paper advt etc

If the Missing Complaint in Police was filed before 7 years the Honorable Court would declare him as Dead following the Procedures and No Need of Divorce from a Dead person.

She should proceed for normal divorce husband being absent.
If she is confirm that he lived with another lady, she may file complaint of bigamy.
If his whereabouts are not known from last 8 years, she can try to get his civil death declared and claim his property as legal heir.

Mr. Naveen,
Your client is eligible to take divorce under sec. 13(1)(vii) of the Hindu marriage act.
Duration is not guaranteed, as that depends upon clear proof of his missing for the last 7 years or more.

As usual, advice of Mr. Doab is quite confusing, as he said, Married lady has told that she knows her husband has remarried. ...... It might be possible to trace him.
The author has asked for divorce, but Mr. Doab advised to trace the missing husband.
By the way, what exactly will be the benefit to the lady in getting divorce, if her missing husband is traced by her or his lawyer?

If husband is alive and known to wife why should she and her lawyer prove the husband dead?

Mr. Doab,
When you don't know anything about law, why you try to confuse the author to complicate the matter for him merely to mislead his client and lose case. Before making wrong advice, you could better have checked the provisions of the HMA.
So, it is not me, BUT ONLY YOU HAVE TRIED TO CONFUSE THE AUTHOR WITH YOUR OLD HABIT OF COMPLICATING THE MATTER ON ACCOUNT OF YOUR OWN IGNORANCE ABOUT THE PROVISIONS OF LAW.
When the provisions of law are very clear with respect to the deserting husband and the lady wishes to to get divorce, why wrong advice has been given by you on the issue? Before taking a wrong stand, it would have been better for you to have a look of the HMA.
Question arises, why she should take a very long and expensive route of making search of her missing husband, when as per law, she can easily get divorce in his absence?
So, you are advised to go through the Act and then decide whether according to the provisions of law you are wrong or absolutely wrong in your advice.

It was decided by experts that we will remain united to handle indecorous querist/authors.

You have really gone berserk, as only you are abusing and telling me as if I am abusing you. You may ask anybody, I am just asking questions for your legitimate replies to my questions. But when you say, "NO IFS, NO BUTS, NOTHING is to be tried and posted by you with me," that means you are afraid of facing the truth about yourself and don't come out of veil to clarify, why in your LCI profile is your fake ID, absence of your picture and absence of the name of city to which you belong. If don't come with the facts about your fake ID, that clearly smacks about your dishonest intentions towards the readers, who try to pose confidence and trust on you.
