Building regularization scheme - ghmc - telanagana state

Sir,

Below is the High Court order copy of Building regularasization schem of GHMC (state of telnagana) request to infrome me the wheather court had given permission to GHMC to regularisaztion of buildings in hyderabad or not,as i am unable to under stand order given by court. For which i am very thankful to you.

Petition under Article 226 of the Constitution of India, praying that in the circumstances stated in the affidavit filed herein, the High Court may be pleased to issue a Writ, Order or a Direction, one more in the nature of a Writ of Mandamus declaring i). the action of the Respondents in proposing to extend the cut off date from 15.12.2007 to 28.10.2015 by way of an amendment to Section 455 - AA of the GHMC Act, 1955 for the purpose of regularizing illegal constructions made within the territorial jurisdiction of the Greater Hyderabad Municipal Corporation by issuing orders in G.O. Ms. No. 146 M A & U D (M 1) Department dated 31.10.2015 as illegal, arbitrary and unconstitutional being in violation of Articles 14 and 21 of the Constitution of India; and ii). the action of the Respondents in proposing to regularize illegal constructions made within the territorial jurisdiction of the Greater Hyderabad Municipal Corporation by issuing orders in G. O. Ms No. 152 M A & UD (M1) Department dated 02.11.2015 as illegal, arbitrary and unconstitutional being in violation of Articles 14 and 21 of the Constitution of India; and iii) consequently quash the orders in G. O. Ms. No. 146 M A & U D (M 1) Department dated 31.10.2015; and iv). further consequently quash the orders
in G. O. Ms No. 152 MA & UD (M1) Department dated 02.11.2015;

The petition coming on for hearing, upon perusing the petition and the affidavit filed herein, and the order of the High Court dated: 22.12.2015 & 03.03.2016 and upon hearing the arguments of Sri Sivaraju Srinivas, Advocate for the Petitioner and of the Advocate General, (TG), for the Respondents, the Court made the following.

ORDER:
Stand over to 21.04.2016 to enable learned counsel for the petitioner to carry out amendment of the writ petition challenging the amendment Act. Interim order granted earlier to continue until further orders.
