Ancestral property

my grandmother(nani ji ) had inherited agricultural land from her father but died in 2012 without making a will she had two sons and two daughters all married before her death, can married daughter claim 25% share in the agricultural land of their mother. my nanaji also died before my nani ji without making any will.

My nani were four sisters and no brothers , all had inherited land through a will equally . My nani was most likely married .

The status of the property acquired by your maternal grandmother should be self acquired.


Her children should be eligible to get equal share.

The fact is that the married status of your nani did not stand in her way of inheriting the property left behind by her father.

So also the married status of her daughters will not deprive her daughters from inheriting the property left behind by her.

But, I think, UP has some special provisions as far as agricultural land is concerned. You have to wait till some one familiar with UP laws in this website responds or you have to get in touch with your local lawyer.

A married daughter can claim her share in the property here.. provided all the conditions fits well.. we have to see the facts of the case in detail.

You did not post that agriculture land is in UP in your first query.


The land is agriculture and devolved from mother.


You may consult a counsel well versed with such matters and laws in UP.
