Divorce case - absent party-in-person

Dear Expert, I am respondent in my divorce case in family court and appearing as party-in-person..case status is filling of counter.if i absent in hearing, what will be the consequences?.May i ask any advocate in that to orally inform the judge as i am sick and not appearing like such? Thanks,Kumar

U have to give vakalat to an advocate to appear for U in the court.

If you are appearing in person, give vakalatnama to your lawyer, he would appear on your behalf.

Normally family courts are not entertaining vakalat. So, you can take the help of your friends to inform the court that you are sick and absent. Many of the advocates are doing this unofficially in order to help their client.

Experts, New Twist: Last hearing also, I didnt went to court, exparte-evidence stage completed and posted date for exparte order. Now my wife said, she dont want the divorce and she asked me to file appropriate petition..Should i file "set aside" petition in HC or in family court?. or different petition? Pl let know as soon.
