Implication of hc order

(Querist) 07 October 2015 This query is : Resolved
In a state case charge framed by court u/s 409/420/506, and case is on evidence. I am complainant/witness of the case and Court issued summon to me to give statement. there are 3 accused in the case. But 1 accused approached the HC u/s 482 and HC ordered "Till the next date of listing, no coercive action shall be taken against the
applicant". I want to know implication of this order. whether my statement shall be recorded or whether all proceedings in the lower court shall be deemed to be stayed or continue . Pl advise

The order of the High Court, as stated, need not be any effect on the summons issued. You need to be present in the Trial Court on the date specified.

It means proceedings at trial court will be continued in normal course e.g. recording of statement , giving evidence by witnesses etc. even against the accused who broght the HC order.

No answer is possible, unless the grounds on which the accused had approached the HC under Section 482 and the relief(s) sought are known.

In fact accused who brought order from hc is bail out and attending the court . He approached the hc after fixation of charge and he prayed for stay of operation of charge order and for proceeding stay
