Cheating case wrt business

Dear Expert,

I along with my partner started a business. we registered it as an proprietor for transaction purpose and had agreement signed for our reference.

Being a service based company we also worked for our orders. He punched two fake orders and has taken the money. The money as not been returned to the organization.

The total amount is aournd 4 lakhs. When I got more doubts and started inquired about him in the market he has done the same for few the same.

I have all the documents and online transaction details stating the investments. He has given one cheque for 50K that also got bounced, thats with me. Please let me konw your inputs.

Note: I would like to file the case and my lawyer can work on percentage basis.

The law doesn't permit any advocate to work on percentage / outcome basis. Such offers should not even be floated through this forum as it being contrary to law.

When you have instead funds , instead of entering into a partnership deed, you have entered into a separate MOU. The contents of the MOU, the details of misuse are to be seen to verify whether the purported misuse by your other man is within the MOU or not. As regards cheque bouncing, you should not loose any more time and file a case under Sec.138 of NI Act. Engage an advocate locally. No advocate will work on percentage basis and it is contrary to the law

You cannot lure any advocate in this manner, it is wrong and illegal. A lawyer can handle your case and he has rights to charge his fee whether the case is decided in his favor or not. The percentage arrangement with the lawyer will deprive him of his earnings if he loses his case so no lawyer will be willing to accept your case on your terms. Better look for a lawyer locally.
