Daughters temporary custody - what precautions to take

Hi,

My wife filed DV case on me & my family members in 2013, where the case was taken back in September 2014 by wife after going with settlement of forceful Mutual Divorce from her end. I have a 5 years daughter whose custody is with me and as per settlement copy she was granted to meet daughter after every four month's last Sunday for 2 hours. Its almost 6 months passed she have not yet attempted to meet the daughter. Got a call from her father they want to meet the daughter this Sunday, I will allow her to meet but what precautions should i take to be at a safer side. (My daughters medical history is she is physically handicap, Please suggest.

As per law girl should be with mother up to attain major. So if she agreed to live with you . you give some visiting rights to her.

Ask them to meet the child at your home and it would better if you do not allow here to take the child away without someone in your behalf remains on toe with them.

Allow the child to meet with her mother whenever she wants her. A child needs both parents and do not deprive her from having this right,

Sir one question, I am feared that she will not return once she take her, as her treatment is going here in pune, I don't want to take any risk Should I filed an NOC at the nearest police station and women cell so that she couldn't file any counter case thereafter as done before

if she is not willing to meet the daughter as per the settlement then you may file an application before the court for dis-entitle to her to meet the child now due to her negligence and non-compliance of the settled terms.

Why do you appear to be so much disturbed if she is not willing to met her daughter, you take care of the daughter properly. If her father want to meet the daughter you may agree on the terms that she can be visited at your home on the time stipulated or else let them petition the court for further orders.
