Proportionate rights on land.

Sir i want to know that by purchasing a flat in a building necessarily grants you proportionate rights on land?
Secondly what does proportionate rights on land mean?

Assume that there is a 100 Sq.yard plot. 10 floors having a flat on each floor is built. The land space that each of the flat owner will have is 1/10th of the total land size i.e. 100/10 = 10 Sq.yards. BUT THIS IS INDIVISIBLE AND UNDIVIDED. Therefore no one flat owner will be able to say which particular portion is his 1/10 share.

Anirudh sir,if the person residing on ground floor takes advantage of covering up open areas/vaccant portion such as lawn then can we file a complaint on the basis of our proportionate right on land?

According to me, so long as he only puts up some shades etc., and does not put up any permanent structure one need not make it an issue. After all, every one has to live there. Rest is left to you. Nobody can stop you from making complaints, but that cannot be on the basis that you have an undivided proportionate share, but on the basis that the other person has indulged in unauthorised construction.
