entry of name in R of R

There is an ancestral property, where partition has not taken place since till today. One of the legal heir died without his name entered in the records of right, now his children wants his father name to be entered, as there name will also follow in entry to get the right in the property. So what procedure is to be followed, kindly advice, as the person is not interested in partition case rather.

Dear Joyce,

After the demised, his name cannot be secured in the Record of Rigts. His legal hiers have jointly secured their names in the record of right along with others.

Procedure as follows

1. file a application along with death certificate and geanolical tree of the demised person.
2. you have to the pay prescribed fee.
3. Thirty days notice wil isuued by concern authority to call for any objections from the interested persons.
4. If there is no obejection from others with in 30 days concern authority will secured all the legal heirs name in the record of Rights.

by giving a vardi to the Tahasildar along with the succession certificate you can get enter the name of the legal heirs of the deceased.

For getting name in the RR,succession cert.is not necessary.No fees are levied.Mr.Desai;s answer is proper.The entry would be final only after it is certified by Circle officer after perusing the papers.

It depends on the nature of property whether it is a land or building, also depends on the prevailing law of the concerned state.
