Cooperative society

(Querist) 01 October 2014 This query is : Resolved 
Our society has elected to the committee and as secretary an associate member who's name is not first in the share certificate.

Although I have razed an objection with the Chairman he has overruled it.

The byelaws and the act say that : an associate member who's name is second in the share certificate can only vote if the member who's name is first in the share certificate is not present. AND NO OTHER RIGHTS.

Please let me know: If I am right & who can I take up the matter with

Associate member is having voting right if the meber is not present.But not entitled to hold the office bearer post.U can challenge the election with the Deputy Registrar.as provided under the Cooperative Societies Act.

Election disputes can be adjudicated only before the Coop. Court.

The Coop. Registrar has no jurisdiction to hear Election Disputes.

You can move an application before the cooperative court mentioning the cited irregularity and seek its intervention.
