Fixing of standard rent in a redeveloped building in k e ward, mumbai

What will be new standard rent for 330 sq. ft. carpet premises in the redeveloped tenancy building in K East Ward against old rent of Rs. 250/- pm ?

Whom to approach in case experts don't have any say on this matter?

Sir/Madam,

Usually the tenants in an old buildings are offered ownership rights in the new construction.

If your old building is redeveloped then you will be given ownership rights in the new building, in which case you will have to pay the maintenance charges and not rent. You become the owner of the flat.

The maintenance charge consists of BMC property tax + other outgoings, on the basis of the area of the flat allotted to you. The property tax is levied by the BMC, other maintenance charges include expenses like electricity, water, watchman, sweeper, etc. expenses.

Dear Mehta Sir, Unfortunately in our case we are pitted against rogue land lord who have fraudulently bought the tanated building owned by public trust with help of corrupt Charity Commissioner and trustees of Bhagwandas Todi Charitable Trust at a lower price then what the tenants had offered to pay. There is said to be underhand dealing and huge bribes have been paid. This apart now we want to understand the new standard rent as the new landlord is not willing to convert the tenancy in to ownership. Hope to receive your guidance in the matter.

Madam,

If you have valid rent receipts for the period of your residence and if you have been paying the rent regularly, no landlord can make you vacate your rental premises. Neither can he demand any enhanced rent. Your status as a tenant is not effected in any adverse manner, you continue to be a tenant of the new landlord with full protection from the Maharashtra Rent Act 1999. You have to continue paying the regular rent to the new Landlord.

The new landlord can not increase the rent, unless heavy repairs to the building have been carried out at considerable expenses.

If the new landlord wants to redevelop the old building he will need your consent.

The standard rent can be fixed by the Court of Law only.
