Notice under section 160 cr.p.c.

(Querist) 03 May 2014 This query is : Resolved 
(i) Can Police call some witness of other province on the strength of section 160 Cr.P.C.? If yes, the ruling reference may be communicated in reply.
(ii) Is it possible that Police call some witness under reference of some Memo no. and not of any specific case?

1. Yes, the police can send a written notice u/s 160 Cr.P.C. to such witnesses residing in another province provided that the witnesses has been named by the complainant in his complaint to the police.

2. The police can record the statement of the witness through electronic means also if the witnesses cannot come to the police station u/s 172 Cr.p.C.

3. Such recording of the statement of the witnesses called u/s 160 Cr.P.C. has to be entered in the station diary of the police station.

4. If the complaint is non-cognizable then such witness can refuse to attend to the direction mentioned in the notice.
