Can a person charged under 304-A be convicted under 302 later on the basis of the evidence?

If the Evidence is Strong and Acceptable by Court 304A could be changed as 302.If it is proved that the Death had been Caused intentionally it would be Murder and IPC 302 would be filed where as in 304A it is only death caused by Negligence

Person can be convicted on the charge framed by court. But charge can be amended at any stage during trial on the basis of evidence.
