Want permission from dj for debottar property

(Querist) 28 August 2013 This query is : Resolved
Respected Sir,
I want to sale a DEBOTTAR property. This property is situated in Varanasi (Uttar
Pradesh). We have filed our case “Hindu minor and guardian ship act 1956 Section-8”in
the court of DJ Varanasi.
For sale of this type of property; we will have to take a prior permission to District Judge.
This type of restriction enforced after the case of Allahabad High Court
Shyamal Ranjan Mukerjee Son of ... vs Nirmal Ranjan Mukerjee Son Of Late ... on
30 August, 2007
Author: S Srivastava
Bench: S Srivastava
JUDGMENT
S.N. Srivastava, J.
“A writ of mandamus is further issued commanding State of Uttar Pradesh not to permit
any alienation of any property attached with any Temple and other Religious Institutions
(Mutths, Temples, specified Endowments which also includes Samadhis and other
Religious Institutions) etc. without prior permission of the District Judge
concerned.”
Our problem is we do not have deed. So we are unable to produce the above case
(Shyamal V/s Nirmal Ranjan) ruling in front of DJ.
Our humble request is kindly sagest any ruling.
Yours Sincerely
Amitabh Mishra

This order was necessary as permission of DJ is always necessary for development of religious trust property.
