(Querist) 29 September 2009 This query is : Resolved 
'A'executed a document styled as sale deed in one hunders rupees stamp paper infavour of 'B' further 'A' agreed to registered the sale deed infavour of 'B' or his legal heirs but now 'A' refused to registered sale deed, subsequently 'B' sent a legal notice calling upon the 'A' to registered the sale dee, after receipt of the notice 'A' sold the proprety to 3rd party.
Now what are the relief's 'B'can sought before the court of law?

File civil suit against A & third for specific perpormane for execuion of sale deed & alternative refund earnest money if any with interest & declaration of sale deed is ab initio void and said sale deed is not binding on A.

File suit for specific relief before the proper court of law and obtain stay seeking restrainment of further sale by subsequent vendee. Seek the quashing of further sale and registration of sale-deed in ur favour in the relief.

U have said A has exeucted doucment styled as sale deed. If it is agreement of sale then u go suit for specific performnace of contract. If it is unregd., sale deed then u have no case. It cannot be admitted in evidence.

b has to go for cancellaltlion of sale deed executed by A to the third parties by placing ur agreement and understanding before the court and also ask for perform the contract in between u and A.
