Validity of will kept in custody of one of the beneficiary

(Querist) 22 May 2013 This query is : Resolved
If the Testator of the WILL keep the Original WILL in the custody of one of the Beneficiary of the WILL and dont want to keep it with others, whether the same is O.K/valid under LAW and cannot be challenged by other Beneficiary/ies ?.
ashutosh mishra (Expert) 22 May 2013
A testator is free to do such exercise but it is advisable not to do so if HE really intends his will to be enforced.
Raj Kumar Makkad (Expert) 23 May 2013
It hardly matters at which place the testator had kept his will during his life time. The crux of the matter is that the will is always challengeable by the aggrieved persons.
