Criminal Contempt of Court Questions?

(Querist) 21 September 2009 This query is : Resolved 
One person makes different statements in different court proceedings (FIR, Magistrate, High Court, State Cosumer Forum) which are in total contradiction and false. Now my question is that can I file a common contempt of court application for all the cause of actions? Also before court will it lie? Can a common application lie directly before Supreme court? Do I need some prior approval from concerned court or Attorney general before filing contempt of court application? pls let me know.riven

If any direction of the court has willfully disobeyed and violated then it creates contempt of court but in the given fact, such thing is absent hence there is no contempt of court, however, an application can be moved before each and every courts wherein contradictory false facts have been brought to initiated proceedings against such person under the provisions of section 340 Cr. P. C. When no contempt lies, further question end.riven

U can't file contempt of court on this point but u can file application u/s 340 of Cr.P.C.riven

no contempt of court proceeding can be initiated for contradiction of the statements of the witness. but if the accused persons are acquitted they may file a malicious prosecution against the complainant.riven
