U/s 138 of negotiable instruments act.

Dear Advocates,

I have a query that

in a 138,Negotiable Instruments act, a lower court convicted the accused for a fine of Rs.10000 and Imprisonment for One month.

The accused came to first appeal.

Can we request the appellate court to modify or to enhance the lower courts judgement without filing cross appeal?

If it is possible, can you provide any citation regarding this.

Probably being complainant hence no body has shown interest in your querry.

If the accused and his / her advocate does proper home work chances of setting aside the conviction are more., since it is a technical law and most of the time in over confidence the complainant make many, many, many and many mistakes for defense to exploit.
