Dear Sirs, i have booked a flat in april 2010 at satara maharashtra. paid booking amt of 2.5 lac on april2010. but due to some problem builder have not started the work for 16-18 months. latter on in june 2012 he started work by & by december he completed 4 th slab & send demand letter of Rs 6 lac.registration was done in dec first week 2012. now he wants us to pay interest charge for last six months as loan arrangement has been delayd from our side after registration. builder is an ISO certified. we requested him if he want to charge us interest on last 6month.(i.e when he began work to work till 4th slab. then he should also pay us interest on amt 2.5 lac that he kept with him for 18 months. he is refusing & saying we have got price apprciation(i.e booking rate 2100 & now gone to 2700) sohe will not pay interest to us. what should we do now. morever due to his delay we have to pay excess amt on vat. pl help

The plea of the builder is absolutely correct. As you are being offered the property on the same rates and even you have accepted it by paying subsequently demanded Rs. 6 lakh so have no claim for the interest rather you shall have to pay him interest on the agreed amount to be paid 6 months ago.

Pay to builder , as u wanted bank loan, not he.
If u delay to pay, u must pay
If u cancel deal, u loose appreciation.
