498a complainant not coming to court for deposition

(Querist) 20 September 2012 This query is : Resolved
Hello Experts,

In my 498A, summons were served to complainant and they appeared in the court.

Since then after we(accused) attend the court regularly but for each date complainant remains absent and their lawyer asks for next date. Almost 5-6 dates has gone like this.

What application / actions should be taken to make complainant come to court and give the statement ??

Please suggest.

Why re you attending then anyway?
You can also remain absent. Your advocate need to file only one regular absent petition.

The ask the court to issue W/A against her to ensure her presence in the court.

Once you are accused of and attending the court, no matter witness attends or not, you have to attend. You can not seek parity to remain absent. Request your advocate to oppose any more adjournment for their attendance.

U R welcome. Dont lose hope. God sees the truth; but waits. I hope you all come out of hot waters. Request your advocate to do the needful at the earliest.
