Fir through post

dear sir,

i am 84 years old and in possession of my anchestral home in a village in garhwal, uttarakhand . the house is over 90 years old and though it does not have market value it has great heritage value for my father was one of the most famous sons of uttarakhand.

i spend six months every yr from 1989 to tghe village and six months in calcutta.

in end july my elder brothers son came to me in dehradun where i was canvalescing after a hip fracture and asked for keys of the village house. i refused.

he then went up to the village broke open the locks with a locksmith help stayed for two days, and changed the lauyout of the rooms .he emailed to my other nephews that he took permission fromm me to break the locks which is not true.

i have sent an fir to the sho and also sent a copy to ssp there for lodging of fir through post stating my inability to be present there in person.

how do i ensure that the fir would be registered.

i am 84 years, with a broken hip bone and walk with a walker but would be fit to visit village not before 8 -9 months.

my nephew bbelongs to delhi and has never stayed there.

You can authorise any person close or related to you to lodge the FIR.
You lodge complaint with higher authority of Police as well
If in spite of all these the Police does nothing then file petition u/s 156(3) crpc.
The courts in Kolkata are very active in this.

dear barman sir,

yes though i am a native of uttarakhand, i have been living in calcutta most of my life.

would it be possible for me to file the petition us 156(3) at calcutta while fir is lodged at uttarakhand.

i have already sent copy to ssp and propose to ask the ssp for copy and also write to the dgp and the chief minister .

should i approach the court if i do not get a response, i mean a court at calcutta

I regret that court at Calcutta has no jurisdiction to try criminal offence happened in Uttarakhand.
However apart from breaking of lock any other criminal acts have occurred in Calcutta, court in Calcutta could be moved.

Agreed with Shri Barman's advised.

Earlier when I complaint as Advocate for victim, to Police Station by Regd Post in UP, it was entertained and acted upon.
u mat try thru Shri Adv Barman, as u r in Calcutta.
As this is very special case of v very Sr. Citizen, it will be looked upon.

you can send RTI application to SSP Uttrakhand District, where is your village is situated and ask him about the proceeding, they are bound to give you the information within 30 days of the receipt of the application.
