Society maintainance charges

(Querist) 17 April 2012 This query is : Resolved
I have shifted to my resale owned flat. My society chairman asking for balance maintenance charge before my procurement, whereas society already issued me society NOC without recovering balance amount from previous land lord. Can I have to pay the balance maintenance charges to society though it Is society’s mistake why he released the NOC. Who should pay the balance amount when previous owner doesn’t reply for the same? The amount is rs. 12000/- apx.
Please guide me.

Normally if the ex owner is liable when it is really arrier iff he was the defoulter then you write a letter to ur society along witth the NOC.

previous owner is liable for maintenace prior to your purchasing flat . society will not transfer flat in your name untill dues are cleared by previous owner

The flat won't be transferred unless arrears are cleared.

Contact previous owner for the same.

Respected Experts,
Thanks to you for your valuable information.
My next question is 1) if ex land lord is not paying the balance amount and society is saying the balance amount is on ur flat no then you have to pay.
In this circumstances what will be my reply. society also charging penalty as an interest with 18% per anum on the balance amount.

2) from whome the society recover the money of maintainance.

Please guide me.

Regards,
Adi
