Problem with Advocate/Advocate Extorting Money

(Querist) 07 July 2009 This query is : Resolved
My advocate is collecting huge amounts on account of Court Fee, the subject of which is out of my knowledge and says that since my case is complicated one he needs to bribe some one to get the case on the bench. The bribe amount as per him runs into half a lakh rupees.

My case is simple one and is to obtain certified copies of certain information from District Registrar under Specific Releif Act.

On some account or other he says he needs money.

How do I obtain No objection Certificate and my case related papers from him as I do not want to continue with his service.

This may sound offending, but it is true, what is the solution for this?
adv. rajeev ( rajoo ) (Expert) 07 July 2009
If u r suffered because of your advocate u need to change him. U request him to give no objection on the vakalat, if he didn't then issue a notice to him to withdraw the vakalat. You be present on the court and inform the court regarding change of the advocate.

In addition to Kiran answer in the form of question, I am also amazed that you want the District registrar to issue you copies under the Specefic Relief act: kindly elaborate. As regards your advocate you are lucky that he is not asking you to sell your kidney to get the copies from the District Regisrar. If adviced, you may aproach the Consumer Court in your District for deficiency of service of your Counsel.

you issue a notice to your advocate informing that you have cancelled his vakalatnama and that he should return all your papers as well as give his NOC. If he complies with the notice, well and good. If he doesnt, you may take up the matter to the Bar Council. Secondly, you may submit fresh vakalatnama without NOC of earlier advocate informing the Authority concerned that the earlier adv has not given NoC despite notice.
