Dear Sir
My Qrry is Can a Co-operative Housing Soc. in Mumbai hold a right as owner to a Tenant.
An area in Prabhadevi mumbai developed in 1979 and the tenants on that plot allotted 180sqft rooms with common toilet in the same building. When society formed these tenants were not included in Society members. Society have been treating them as a tenants from last 35 years. Is that lawful?

there must have been agreement executed between landlord and tenants . tenancy receipts given . when was society formed ?
who are the society members?
were flats sold on ownership basis?

Agreement was made between landlord and tenant which only speaks about leaving the plot and to accept the new rooms in the building developed on same plot. Later on society formed of flat owners who bought it on ownership basis. Please advise . Over the years they treat us tenants. No parking, no rights to us. They call the meetings and takes any decision on us. Also abiding us not to sell our rooms to outsiders but to society members only.
