Execution of will

(Querist) 29 March 2012 This query is : Resolved 
A person made a Will. The same was registered with sub registrar of assurances. Now the testator has died.
Querry: What is the procedure for executing Will? Is the cover to be opened in the presence of family members and then the executors will approach court for obtaining probate? Pls adv. Tks

Depends on state.

In Delhi probate is not needed for a will, in certain states it is mandatory.

Yes!If the Will was kept in sealed cover with registrar ,the executor should apply before the registrar for it's opening and registering on proving death of the testatorand there after he should apply for probate.
Probate even if not required by law at some places but yet it it is of usefulness s will gets finally proved once for ever.
