Application for birth certificate .....

sir,

My client is from Thakor Community. They had not registered her daughter's name in birth & death register maintained by municipality.

unfortunately, she is 22 year old but illiterate and uneducated so she does not have School leaving certificate.

Now she wants to register her marriage.

so the question is that whether the certificate issued by Civil Surgeon is valid certificate for age confirmation?

is there any judgement of SC or any of HC?

We have filed a petition in JMFC for getting order for birth registration. now how to convince the court the approximate date of the girl.... because Judge asked the proof of birth date of the girl...

its urgent because parents of girl are ready for the marriage but not the boy's father......

Birth certificate issued from hospital, or a report of radiologist regarding age determination is valid.

I think without seeking relief from court birth can be registered as procedure laid down in Sec 13 (1)(2)(3) Registration of birth and death act.

Certificate granted by the registered medical practitioner not below the rank of a Civil Surgeon supported with Self swearing Affidavit by an applicant before an executive Magistrate or a First Class Judicial Magistrate or a Notary Public as evidence of age and address is sufficient evidence in this regard.

normally the registration of birth is done automatically,provided the concerned hospital intimates the same to the nearest local body(panchayath/municipality etc)
