Whether fir can be lodged ?

I lost my mobile phone during journey. When i approached to police station to file a FIR for the same the police officer refused to file FIR. kindly advise whether police can refuse to file FIR for such kind of incidences ?

No you can send it by the registered post to the officer of the concerned Police station in addition with the higher official of the department with complete details of the occurrence and you have to send an information to the network operator for the blocking of the SIM Card for the precautions of misuse of the no.

generally police refuse to register FIR if you claim it was stolen . . they insist on letter being given about missing mobile phone . since objective of loding FIr is tolodge claim with insurance company on account of non coperation from cops it becomes difficult .

cops cannot refuse to lodge FIR .if local inspector refuses to lodoge FIr you cna lodge complaint with the Supdt of police

Dear Querist.. FIR and Complaint with Police are slightly differ in meaning.So Far FIR is concerned, it is Jurisdicti00n wise..but in case of yours, the procedure applicable herein is to approach the police with compliant therin submiting the fact of lost mobile in order to prevent its misuse elswhre..and to obtain the New SIM of same number....The police has reason to refuse to lodge a complaint on ground of non-producti02n of Purchase bil of the said mobile, if they asks for, further, a police has authority to determine the genuinity of the contents of the complaint, and on aprehension of any otherwise circumstances they may deny to lodge the complaints depands upon the circumstances of ur mode of journey, say for an example ...continued

1. It was lost or stolen?

2. If you have once said, it was lost, police would never register an FIR, as no crime has been done.

3. If it was stolen and police is not registering the FIR, move court.
