It act 2008 - sec 66 c

My wife's office password was saved on my Home PC. We had a fight and she went to her parents.She still has duplicate keys of house with her.

She had given wrong statement to her head office regarding her address. Somebody emailed to her head office regarding this using her account.

Now, she has lodged the complaint that i have hacked her password and sent email to defame her using her email ID.

Whether this is a case of hacking or Sec 66-C of IT ACT 2008. Kindly enlighten.

Sure, it is a case of hacking, as you were not authorised to make any alteration in the personal data of any person and communicate through IT, may be that of your wife. The law is quite clear, it does not provide any immunity to husband or wife.

But Sec 66-C states "Whoever, fraudulently or dishonestly make use of the electronic signature, password or any other unique identification feature of any other person"

Is that case of fraud or dishonesty. Kindly guide. Thanks

Did you use your wife's password to access her mail account and send any mail from her mail-id?
Did you have your wife's permission to do so?
If you did not have your wife's permission to do so, you acted fradulently and dishonestly. The provisions of Section 66-C is very much attracted.
