Enforcement of high court dicree

Querist : Anonymous (Querist) 06 September 2011 This query is : Resolved 
specific performance of contract for sale of land was granted by high court for which supreme court also dismissed the other parties SLP.the execution was remitted to trail court.the time to execute was within 3 months.the other party is continuously filing objection . it has been one year. how can i force the execution soon? can the trail court itself execute the land registry?

In execution of a decree of an agreement to sale the original court where the suit was filed and the execution is going on has rights to execute the sale deed itself if the
judgment debtor does not execute the sale ordered by decree of specific performance.
I am unable to understand what objection the judgement debtor is filing and how you are letting it go unobjectionable and not pressing the executing court to execute the sale deed on its own.

If the JD is not executing the sale deed,you can request court to execute the document and you can also ask court to attach the property and hand it over to you.

If judgment debtor does not execute the sale ordered by decree of specific performance.court will do it.
