False Affidivit

What are the consequences if a person has filed false affidit in DDA to get a flat. As you have to file an affidivit first that you dont have any other property in delhi. The person had got two dda flats and also has other residential proeprty in delhi.

To file false affidavit is a crime and if DDA lodge a complaint to the police or file a suit against you in the criminal court after hearing, if it is proved, court may punish you with fine.The maximum punishment is six month simple imprisionment.

There is no punishment for filing the false affidavit.Only if the false affidavit is filed before any judicial officer, the punishment will be awarded.

In this case no punishment, at the worst situation the allotment may be declined.

If one acquires a flat by filing false affidavit, the allotment can be cancelled on that ground. Will it not amount to cheating punishable u/s 420?

I agree with Mr. Bhagat and Mr. Palnitkar

otherwise the DDA form for the said purpose contains a clause too in this regard.

read the brochure carefully and taking necessary action, the allotment is bound to be cancelled.

if it is not done, serve DDA a legal notice and in case of inaction thereafter proceed as per the advice given by your local lawyer.

Even DDA records might be updated to find out instantly whether the person applyling for third time and he is already holding two flats in his name. The same can be verified by DDA office itself and cancelled the allotment. If the offices cannot maintain their records updates then we are helpless and makes the process tedious and complicated.
