i rented shop in amritsar. initially tenant paid rent by means of crossed cheques for few months therafter he stopped paying and rent for 16 months is due. all verbal requests for payment of rent proved futile.apart he had made subletting .for which he has been receiving rent by crossed cheques from sub tenant.on our request to vacate, he is asking 5lac. kindly guide, for rent he kept us waiting promising that some money he will be receiving from abroad then he will settle our a/c kindly guide how to recover rent and get the shop vacated.

You must issue a notice of termination of tenancy on the ground of sub-letting and arrears of rent. If there are other grounds like causing of nuisance or damaging the property etc, mention those grounds also. Then file suit for eviction.

thanks.sh palnitkar, how much time courts take to decide this type of case. can we claim rentin court also

Normally it takes about 3-5 years for the decision in the first court. You can claim arrears of rent in court also besides damages in lieu of rent from the date of termination of tenancy.
