Domicile Certificate

sir,
borivali tehsildar office is not accepting my domicile application becu. they want my fathers birth proof to judge nationality. my father hav voter id ,pan card, and hav been staying in mum for 30 years. they r not accpting above doc. as nationality proof and asking for birth certi or village bdo cert. or leaving certi. were place and date of birth is there. so guide us wht doc can we submit in terms of legal law of maharshtra and further bec of absense of domicile my admission is cancelled for mca. can i held them responsible under consumer protection act and file legal suit and under what way.my whole career is shattered bec of them. plz guide in this matter. further VIll BDO is not ready to give birth certification since my father age is more than 50 yrs and he says he dont have authority to issue plz guide in this matter also.

What about your original birth certificate?

Country of your own birth can be the proof of your domicile, not your father's. You are not asking for the domicile of your father.

I don't think domicle case falls under the scope of consumer right protection. You may approach to the concerned SDM (Civil) or the District Collector if the Tebsildar is not willing to entertain your application. BDO may not be competent to issue a birth certificate. If your birth was in a village, the birth record may be available with the village pradhan, as is notified to the municipality of the jurisdiction through village chowkidar and are police chowki, etc.

In fact it is not necessary to file birth certificate of father. As suggested by Mr. Dhingra, you make a grievance to higher authorities. If the things do not work, you should file a writ petition in HC.
