RIGHT TO INFORMATION ACT 2005

FACT OF THE CASE- 'X' PERSON FILE APPLICATION UNDER RTI FOR INFORMATION AFTER PERUSAL OF THE DOCUMENT. THE PUBLIC INFORMATION OFFICER FIXED DATE FOR PERUSAL OF DOCUMENT SOUGHT UNDER RTI. ON THE FIXED DATE APPLICANT SENT HIS NOMINEE FOR THE PERUSAL OF THE DOCUMENT. APPLICANT 'X' DID NOT APPEAR.

WHETHER NOMINEE CAN BE PERMITTED INSTEAD OF ACTUAL APPLICANT FOR THE PERUSAL OF THE DOCUMENT UNDER RTI ACT 2005?

In my opinion applicant's presence is necessary, there is no provision of nominee

The applicant can send his representative along with authorization letter.

Yes,applicant's duly authorised represantative can peruse the document.

Duly authorised representative can see the document. However, for your satisfaction and double surety, besides acknowledgement of the representative, acknowledgement of the applicant may also be sought separately.

Dear Rajeev,

If provision of nominee is not mentioned in the RTI Act, it has also not been mentioned that the authorised representative should not be allowed.

Any law should not be taken in negative sense, unless specifically prohibits for a particular act.
